DPDPA brings a new standard for how organizations must manage personal data. Beyond compliance, it pushes companies to build stronger data governance, reduce risk, and increase trust with customers. Achieving this requires clarity, automation, and a step-by-step execution model.

At Ardent Privacy, we built the TurtleShield Platform to help organizations systematically operationalize every key requirement of the DPDPA. Here are six steps through which you can execute DPDPA:

### Step 1: Conduct DPIAs & Risk Assessments

A strong privacy program begins with visibility. Organizations must understand which applications, processes, and data flows involve personal data, and the risks they pose.

**What needs to be done:**

- Perform Data Protection Impact Assessments (DPIAs)
- Conduct risk assessments for business processes handling personal data
- Identify compliance gaps early
- Map risks to Act & Rule-level mandates

**Relevant Law:**

- Act: Section 10
- Rules: Rule 13

**Ardent Solution:** The TurtleShield PA ([Privacy Automation](https://www.ardentprivacy.ai/privacy-process-automation/)) automates and streamlines privacy-related processes and tasks. Conducting PIAs and DPIAs enhances privacy practices, ensures India’s DPDPA compliance with applicable privacy laws, and also protects sensitive information.

### Step 2: Discover PII & Build Your Data Bill of Materials (DBoM)

You cannot protect what you cannot see. Understanding what personal data you hold - across systems, databases, SaaS apps, and unstructured sources, is mandatory for your organization to comply with DPDPA.

**What needs to be done:**

- Discover personal data across all environments
- Build Data Bill of Materials (DBoM)
- Record of Processing Activities (RoPA)
- Classify data & establish lineage

**Relevant Law:**

- Act: Sections 8, 10, 11 & 13
- Rules: 6, 7 & 8

**Ardent Solution:** Our Innovative patented technology "TurtleShield DD ([Data Discovery](https://www.ardentprivacy.ai/data-discovery/))" addresses these challenges by discovering hard-to-find datasets at scale, enabling quick actions, and reducing compliance costs. It locates and categorizes data based on regulatory requirements like DPDPA, ensuring companies maintain compliance, secure sensitive information, and minimize data breach risks.

### Step 3: Implement Data Principal Rights Management

DPDPA places individuals at the center, and organizations must enable citizens to exercise their rights as a data principal with ease and transparency.

**What needs to be done:**

- Build a secure portal for Rights Requests (Access, Correction, Erasure)
- Verify identity and consent
- Track, manage, and fulfill requests within statutory timelines
- Use discovery to precisely locate relevant personal data

**Relevant Law:**

- Act: Sections 8, 11, 12, 13 & 14
- Rules: Rule 14

**Ardent Solution:** TurtleShield's DPRM solution is designed to streamline the complex process of managing [Data Principal Rights Management](https://www.ardentprivacy.ai/data-subject-access-request/) (DPRM) while ensuring compliance with privacy regulations like DPDPA. With robust features and innovative tools, it helps organizations address privacy challenges effectively and efficiently.

### Step 4: Establish a Centralised Consent Management System

Consent is the backbone of the DPDPA. Organizations must maintain a verifiable, auditable, and interoperable consent framework.

**What needs to be done:**

- Centralized collection, storage, verification & withdrawal of consent
- Consent workflows for parents (children) and lawful guardians (for people with disabilities)
- Privacy notices and preference management
- Integration with licensed Consent Managers

**Relevant Law:**

- Act: Sections 4, 5, 6, 8 & 9
- Rules: 3, 10 & 11

**Ardent Solution:** TurtleShield UCM ([Unified Consent Management](https://www.ardentprivacy.ai/consent-management/)) automates required consent notices, the collection and management of consent/opt-out privacy preferences.

### Step 5: Enforce Storage Limitation Requirements

DPDPA mandates strict retention and deletion protocols to avoid over-retention and ensure data minimization.

**What needs to be done:**

- Define retention rules based on type of Data Fiduciary
- Automate erasure schedules
- Maintain erasure audit trails
- Comply with sector-specific timelines (e-commerce, social media, gaming)

**Relevant Law:**

- Act: Sections 8 & 12
- Rules: Rule 8

**Ardent Solution:** TurtleShield DM ([Data Minimization](https://www.ardentprivacy.ai/turtleshield-data-minimization-dm/)) helps you reduce the data and focus on enterprise-centric data. It can provide you detailed insights to get rid of non-essential data, reducing cost of security and storage and building confidence of business owners and data fiduciaries.

### Step 6: Implement Data Breach Management & Notification

DPDPA requires fast, structured, and documented breach response without any delay.

**What needs to be done:**

- Automate breach detection, triage & documentation
- Notify affected data principals and authorities without any delay
- Submit detailed reports to Data Protection Board within 72 hours

**Relevant Law:**

- Act: Section 8
- Rules: Rule 7

**Ardent Solution:** TurtleShield DBM ([Data Breach Management](https://www.ardentprivacy.ai/data-breach-management/)) helps organizations efficiently verify, assess, contain, manage and respond to data breaches including notifying affected individuals and regulatory bodies as per the legal requirements. TurtleShield DBM streamlines data breach management process, handles stakeholder management, accelerates breach response, enabling organizations to notify regulators and stakeholders within the required timeframe.

### Follow DPDPA Timelines

1) Intimate each affected Data Principal and Data Protection Board of data breach without any delay.

2) Granular details to the Data Protection Board within 72 hours of being aware of data breach.

3) Respond to data principal rights requests within a reasonable time but not exceeding 90 days.

4) Retention by Data Fiduciary to detect and investigate unauthorised access, remediate issues, and keep logs/data for 1 year unless law requires longer.

5) Retain logs and personal data for one year for detection, investigation, remediation of unauthorised access.

6) Retain personal data, associated traffic data and logs for one year unless required by other law.

7) Data deletion by e-commerce entities and social media companies with not less than 2 cr users in India, or online gaming platforms with not less than 50 lakh registered users within 3 years if the Data Principal hasn’t engaged.

8) Notify Data Principals at least 48 hours prior data erasure giving them time to take action.

9) Maintenance of consent records for 7 years by the Consent Manager.

**By following these steps, organizations can achieve compliance and also build a privacy-first culture that fosters trust among stakeholders.**
