India’s Digital Personal Data Protection Act ([DPDPA](https://www.ardentprivacy.ai/india-digital-personal-data-protection-act/)) introduces important requirements for organizations handling personal data. Among these, consent and Data Principal rights are two closely connected areas that serve different purposes within an organization’s privacy program.

Our recent webinar, “**Consent and Data Principal Rights: Understanding Their Distinct Roles Under DPDPA**,” explored these differences and discussed practical considerations for organizations preparing for DPDPA compliance.

**Understanding Consent Under the DPDPA**

Consent is an important basis for processing personal data under the DPDPA. Organizations need to ensure that consent is obtained through a clear and compliant process.

Consent must be free, specific, informed, unconditional and unambiguous, and obtained through clear affirmative action.

However, consent management does not end when consent is collected. Organizations also need to consider how consent is recorded, managed, tracked and withdrawn throughout its lifecycle.

**Understanding Data Principal Rights**

The DPDPA gives Data Principals rights that enable them to exercise greater control over their personal data.

**These include rights relating to:**

- Access to information about personal data
- Correction and erasure of personal data
- Grievance redressal
- Nomination

Organizations need defined processes to receive, verify, track and fulfill these requests while maintaining appropriate records and accountability.

**Consent Management vs. Data Principal Rights Management**

Although both areas are part of a broader privacy program, their objectives are different.

Consent Management focuses on obtaining and managing a Data Principal’s permission for processing personal data.

Data Principal Rights Management focuses on enabling individuals to exercise their rights and ensuring that organizations can respond to those requests effectively.

Both require clear processes, defined responsibilities, appropriate records and effective workflows.

**Key Takeaways from the Webinar**

The discussion highlighted four important considerations for organizations preparing for DPDPA compliance:

- **Consent is an ongoing lifecycle —** organizations need to manage consent from collection through withdrawal.
- **Data Principal rights require structured processes —** organizations need clear workflows for receiving and fulfilling rights requests.
- **Consent and rights management serve different purposes —** they should be treated as distinct processes while remaining connected within the privacy program.
- **Technology and accountability matter —** organizations need appropriate workflows, records and ownership to manage these requirements effectively.

**Building a Structured Approach to DPDPA Compliance**

Preparing for DPDPA compliance involves more than establishing policies. Organizations need practical processes to manage consent, respond to Data Principal requests, maintain records and demonstrate accountability.

A structured approach to Consent Management and Data Principal Rights Management can help organizations operationalize these requirements as part of their broader privacy program.
